General Terms and Conditions of Use


Section 1 - Definition

We will designate:

- 'Website' or 'Service': https://www.france-hotel-guide.com and all its pages.

- 'Benefits': All the benefits and accommodation services that can be booked on the site.

- 'Publisher' or 'Owner': the owner for the proposed accommodation and the person responsible for the publishing and content of the website.

- 'User': The Internet user who visits and uses the website

- 'Client': The Internet user who makes a reservation on the site.

Section 2 - Information required by the law of trust in the digital economy and purpose of the site

This website is published by France Hotel Guide. Legal information concerning the host and publisher of the site, in particular, the contact details and any capital and registration information, is provided in the legal notices on this site. Information concerning the collection and processing of personal data (policy and declaration) is provided in the website's personal data charter. The site is freely accessible to all Internet users and allows them to consult the accommodation offers and request the reservation of one or more accommodations. The reservation of accommodation or, more generally, the navigation on the website implies the user's acceptance of all the present general conditions, which he/she acknowledges having read them in full. This acceptance may consist of, for example, the Internet user ticking the box corresponding to the acceptance sentence of these general conditions with the words "I acknowledge that I have read and accepted all the general conditions of the site”. Checking this box will be considered to have the same value as a handwritten signature from the Internet user. The acceptance of these general terms and conditions presupposes that the users have the necessary legal capacity to do so. If the user is a minor or does not have this legal capacity, he/she declares that he/she has the authorisation of a guardian, a curator or his/her legal representative. The Internet user acknowledges the evidential value of the automatic registration systems of the publisher of this site and, unless he provides proof to the contrary, he waives the right to contest them in the event of a dispute.

On the site, the Publisher makes available to the Client a confidentiality charter specifying all the information relating to the use of the Client's personal data collected by the Publisher and the rights that the Client has with regard to these personal data. The data privacy policy is part of the CGUV. Acceptance of the CGUV, therefore, implies acceptance of the data privacy policy.

Section 3 - Characteristics of the accommodation services offered

The services and accommodation offered are those listed on the pages of the site. Accommodation is provided within the limits of available places. Each accommodation is accompanied on the website by a description drawn up by the owner. The photographs of the proposed accommodation reflect a true and fair view of the accommodation but are not contractual as they cannot ensure a perfect similarity with reality. France Hotel Guide also provides users of the site and its customers with telephone assistance to answer their questions. Section 4 - Prices

The prices of the accommodations listed on the site are understood in Euros with all taxes included (TTC), taking into account the VAT applicable on the day of the order, excluding any tourist tax.

France Hotel Guide reserves the right to reflect any change in the VAT rate on the price of accommodation. The owner also reserves the right to change its prices at any time. Nevertheless, the price displayed on the site on the day of the order will be applicable to the buyer.

Customers booking accommodation must pay a tourist tax, which is fixed by decision of the municipal council concerned by the accommodation booked, if they are not domiciled in the municipality and do not own a residence there for which they would be liable to the housing tax. This tourist tax, if it is not explicitly added to the price of the accommodation and paid at the time of booking, may be applied and requested on site at the end of the stay. In any case, it will be detailed to the customer, if applicable, on the invoice given to him/her.

Section 5 - Duration of stay

The client who signs the contract concluded for a fixed period may under no circumstances claim any right to remain in the premises at the end of his/her stay.

Section 6 - Exemption of the publisher from liability for the performance of this contract

In the event of access to the site being denied due to technical problems or of any other nature, the user will not be able to claim any damages or compensation. The unavailability, even if prolonged and without any time limit, of one or more services offered by the site may not constitute a prejudice for Internet users and may in no way give rise to the award of damages by the site publisher. The photographs of the accommodation and services presented on the site are not contractual in nature, and the publisher of this site, therefore, cannot be held liable if the characteristics of the accommodation differ from the visuals on the site or if they are incorrect or incomplete. The hypertext links on this site may lead to other websites and the publisher of this site cannot be held liable if the content of these websites contravenes current legislation. Similarly, the publisher of this site may not be held liable if the Internet user's visit to one of these sites causes him/her any damage.

Section 7 - Intellectual property rights related to the elements published on this website

All elements of this site belong to the publisher or a third party agent, or are used by the publisher on the site with the permission of their owner. Any copy of logos, textual contents, pictographic or video content, without this enumeration being exhaustive, is strictly prohibited and amounts to counterfeiting.

Section 8 - Limitation of liability

The site publisher, particularly in the online booking process, is only bound by an obligation of means; its liability cannot be held liable for any damage resulting from the use of the Internet network such as a loss of data, intrusion, viruses, service interruption, or others. The publisher of the site, France Hotel Guide, cannot be held responsible for the non-performance of the contract concluded due to the occurrence of an event of force majeure. The user expressly agrees to use the site at his/her own risk and under his/her sole responsibility. The site provides the user with information for information purposes only, with imperfections, errors, omissions, inaccuracies and other ambiguities that may exist. Section 9 - Access to the website

The website editor cannot be held liable for any technical unavailability of the connection, whether due to force majeure, maintenance, updating, modification of the site, intervention by the host, internal or external strike, network failure, power failure, or even incorrect configuration or use of the user's computer.

Section 10 - Applicable law and mediation

These terms of service are subject to the French applicable law. They may be modified at any time by the site publisher or his/her representative. The terms of service applicable to the user are those in force on the day of his/her reservation or connection to this site. Section 11 - Use of Cookies

A "Cookie" allows the identification of the user of a site, the personalization of his/her consultation of the site and the acceleration of the display of the site, thanks to the recording of a data file on his/her computer. Section 12 - Services related to the reservation of accommodation

Scope of our service: France Hotel Guide allows you to make a direct reservation with the hotel of your choice. By accessing our website, conducting research and/or making a reservation, you declare that you have read these general conditions and accept them. The information we provide is based on information provided by hotels. Many hotels are presented as part of an affiliation agreement with Booking Holdings. The contents (photos, texts, prices, etc.) displayed in France Hotel Guide are therefore those delivered by this company as part of their contractual agreements with the hotels concerned. Although we strive to provide a quality service, we cannot verify or guarantee that all information is accurate, complete or correct, and we cannot be held responsible for any error (manifest error or typographical error), service interruption (due to a technical failure, failure, repair, update, maintenance of our website or otherwise), inaccurate or incorrect information, or a lack of information.

Bookings: Bookings can be made in different ways depending on the hotel, either through "Online Booking" mode or "Booking Request" mode. Below, you will find the necessary information on these different booking methods.

Cancellations: By making a reservation in a hotel, you acknowledge that you have read and accepted the hotel's cancellation and non-attendance conditions, as well as any additional conditions of the hotel that may apply to your reservation or during your stay, including for the services and/or products provided by the hotel (the general conditions of the sale of a hotel can be obtained from the hotel itself). The general cancellation and non-attendance conditions, specific to each hotel, are recalled during the booking process and can be consulted from the booking confirmation email. Please note that some rates or special offers do not allow you to cancel or change your reservation. You are therefore invited to read the conditions of each offer before making your reservation. Please note that each cancellation may result in a fee, in accordance with the hotel's cancellation and non-attendance conditions. We advise that you read these cancellation and non-attendance conditions carefully before making your reservation. Below, you will find the specific cancellation terms and conditions depending on the booking method used.

"Online Booking" mode

Description: Many hotels allow you to book in "Online Booking" mode, by which you buy your stay in real-time directly from the hotel with immediate confirmation. Rooms and prices offered under the "Online Booking" mode are put online directly by the hotel owners under their own responsibility. Please note that a unique reference number is associated with each reservation. The "Online Booking" mode uses technology and servers from either Availpro (www.secure-hotel-booking.com) or Booking.com (secure.booking.com).

Under the "Online Booking" mode, some hotels request online payment for part of the total amount of the booking, the rest must be paid on arrival. Some hotels require online payment for the full amount of the reservation. Finally, some hotels do not require online payment, only your credit card number. In any case, before making your payment and/or presenting your credit card number, it is advisable to carefully read the terms and conditions of sale applicable to the hotel by clicking on the "Terms and Conditions" link for www.secure-hotel-booking.com or on the "Terms and Conditions" link for secure.booking.com.

Cancellation of a reservation: You can cancel a reservation made in the "Online Booking" mode and be refunded if you have made an online payment. To cancel a reservation made by www.secure-hotel-booking.com, go back to the hotel's web page, then click on the "Online Booking" link or the "Book Now" link. Then click on "Cancel a reservation" and follow the instructions (please note that in cases where you have made an online payment, a small bank charge will usually be applied). For reservations made by secure.booking.com, please follow the instructions in the confirmation email. In any case, if you cancel after the deadline specified by the hotel or if you do not show up at all, the hotel may retain a penalty, usually equivalent to one night. Any possible disagreement or dispute with the hotel occurring after the scheduled arrival date must be dealt directly with the hotel concerned.

Data protection and privacy: Availpro uses Thawte® SSL Encryption. The payment software is managed by CIC. Transactions are carried out on Availpro's servers, which are checked 24/7 by ip-label.net. Booking.com uses the latest SSL encryption available that encodes all your personal data, plus a specific guarantee. "Booking Request" mode

Description: In "Booking Request" mode, you start by sending a booking request directly to the hotel using the France Hotel Guide form. Then the hotel answers you by e-mail with its availability. If the hotel has availability for your dates, you then confirm your reservation directly with the hotel. If you have not already done so, it is advisable to provide your credit card number to the hotel by any means you deem appropriate. Please note that a unique reference number is associated with each reservation. Please always remember this reference number and "France Hotel Guide" for all communications with the hotel.

Cancellation of a reservation: To cancel a confirmed reservation in "Booking Request" mode, you must inform the hotel directly of your cancellation by indicating your reference number and dates. You can use e-mail, fax or telephone. Cancellation conditions are generally to respect a deadline of 48 hours before the date of your arrival, but the conditions may vary according to the hotels. If the cancellation is made after the deadline or if you do not show up at all, you will normally be charged a fee on your credit card, usually the price of one night.

Tourist tax

• Tourist tax is mandatory: it applies to all tourists (except children under 13 years of age) and is collected by hoteliers. The rates of the tourist tax are set by the municipal council according to a national scale which depends on the nature of the accommodation. Currently, the rate of tourist tax can vary between 0.20€ (minimum) and 4€ (maximum) per person and per day.

• The room prices indicated on France Hotel Guide generally include tourist tax. When this is not the case, the amount is then specified.

Section 13 - Archiving

France Hotel Guide will archive purchase orders and invoices on a reliable and durable medium that constitutes a true copy. The computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Section 14 - Framework of conditions

If any provision of the Terms and Conditions is found to be unlawful, void or unenforceable for any other reason, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of the remaining provisions. These terms and conditions describe the entire agreement between the user and the website. They replace all previous or contemporary written or oral agreements. The general terms and conditions are not transferable or sublicensable by the user himself/herself.

A printed version of the Conditions and any notices given in electronic form may be requested in judicial or administrative proceedings relating to the General Conditions. The parties agree that all correspondence relating to these Terms of Use must be written in the French language.

Section 15 - Notifications

Any notice or notice concerning these general terms and conditions, the legal notices or the personal data charter must be given in writing and must be delivered by hand, registered or certified mail, by post or any other nationally recognised courier service that regularly tracks its packages, or by e-mail to the addresses indicated in the legal notices on the site, specifying your full name, address and purpose of the notice.

Section 16 - Complaints

Any claim related to the use of the website, the service, or any other related service, the pages of the site on any social networks or the terms and conditions, legal notices or personal data charter must be filed within 365 days of the day on which the problem giving rise to the claim occurs, regardless of any law or rule of law to the contrary. In the event that such a claim has not been filed within 365 days, such a claim shall be forever inapplicable in court.

Section 17 - Inaccuracies

Throughout the website and the services offered, it is possible that there may be, to a limited extent, inaccuracies or errors, or information that is inconsistent with the general conditions, legal notices or personal data policy. In addition, it is possible that unauthorized modifications may be made by third parties to the site or to related services (social networks, etc.). We are making every effort to ensure that these types of discrepancies are corrected.
